Child Abuse Penalties and Laws in California

According to California law if you are a teacher, school official, caregiver, physician, firefighter, police officer, E.M.T., paramedic, counselor, or any person that is in charge of children or is in a public position, and you suspect child abuse you must report it or face up to 6 months in jail and a $1,000 fine.  Additionally, penalties for an individual convicted of child abuse in California include:

  • Up to 6 years in State Prison
  • Large monetary fine
  • Probation
  • Counseling
  • Possible registration as a sex offender

If the child abuse results in death then you will be facing murder or manslaughter charges and could face 25 years to life in prison.  When you work with a defense lawyer at the Law Offices of James E. Blatt, we may be able to conduct our own investigation and discover additional evidence that builds a case in your favor. When defending your case we will challenge the evidence provided by the state and we will make sure that the evidence was not tampered with. In some cases your attorney may be able to easily obtain a dismissal due to either a lack of evidence or evidence tampering.
